FAA’s power to police civilian drones bolstered by U.S. ruling

The Federal Aviation Administration’s authority to regulate civilian drones was upheld Tuesday in a ruling that gives the U.S. government more power to police the fast-growing use of unmanned aircraft.

People need to read the actual decision. It is very narrow in scope.

At this stage of the proceeding, however, we decline to address issues beyond the threshold question that produced
the decisional order on appeal: Is respondent’s unmanned aircraft system (UAS) an “aircraft” for purposes of § 91.13(a), which prohibits any “person” from “operat[ing] an aircraft in a careless or reckless manner so as to endanger the life or property of another”?11 We answer that question in the affirmative.

So in this specific case the NTSB declared that Pirker was flying an "aircraft" and that the FAA could apply 91.13 to his specific flight. He had tried to get around the fine by saying he was flying a "model airplane" not an "aircraft".
